AG Yost Statement Regarding Texas vs. United States

(COLUMBUS, Ohio) – The following statement may be attributed to Ohio Attorney General Dave Yost regarding the decision of the Fifth Circuit Court of Appeals in Texas vs. United States, challenging the constitutionality of the Affordable Care Act:

“Ohioans can breathe easier tonight — the Court agreed with Ohio’s argument and only struck down the bad part of the law, deciding to cut out the tumor rather than kill the patient. Pre-existing condition protections remain in place. This was the right decision on the law. I will continue to fight to protect Ohioans and the rule of law.”

Yost was one of two Republicans who argued that — although the individual mandate was now unconstitutional because Congress zeroed out the “tax” that supported it — the remainder of the law, including protections for pre-existing conditions, was still valid.
