Vehicle Damage Suit Against County Dismissed

A lawsuit seeking damages against Knox County Engineer Cameron Keaton, Knox County Commissioner Teresa Bemiller and Pleasant Township Trustee Dave Smith has been dismissed in Mount Vernon Municipal Court. The suit sought compensation for personal injury to a driver and to a vehicle allegedly caused by a pothole on Range Line Road outside Mount Vernon. Assistant Prosecuting Attorney Vince Villio filed a motion to have the case dismissed with prejudice after the Plaintiff’s counsel did not respond to requests for discovery. Judge John Thatcher granted the motion, meaning that the case cannot be refiled.

County Prosecutor Chip McConville says this is a great outcome for the county. “Not only was the case dismissed, but we were able to handle this in-house, saving the county any outside counsel fees and insurance deductible payments.”
