Carfagna Acts to Close Cocaine Loophole

 

Thanks to our new state representative, Rick Carfagna (R- Genoa Twp) for co-sponsoring House Bill 4. This important legislation would remedy a December decision of the Ohio Supreme Court that complicated the weights needed in cocaine possession and trafficking cases.

Under the Court’s decision in State v. Gonzales, prosecutors must now show how much pure cocaine is present in confiscated drugs. Practically speaking, this is difficult for labs to accomplish, because nearly all cocaine has been cut with filler agents like powdered baby formula.
